In short. Your data is yours, it is walled off from every other customer and from our advisory practice, and we do not train models on it. What the platform produces is analysis for a professional to act on, not advice and not a finding about any person. You pay per matter, and you see the page count before any per-page charge. The full terms follow, and they govern where this summary is shorter.
These terms are an agreement between you and Blue Horizon Group LLC, a Georgia limited liability company that owns and operates Illuminate Risk (“Illuminate Risk”, “we”, “us”). They govern your use of the Illuminate Risk platform and this website.
If you use the platform on behalf of a firm or other organization, you agree to these terms on its behalf and confirm you have authority to do so. That organization is the “Customer”. The people it authorizes to sign in are “Users”.
Where a Customer has signed an order form, engagement letter or other written agreement with us, that agreement controls wherever it conflicts with these terms.
The platform is forensic analysis software, reached at portal.illuminaterisk.ai. It includes RAE (risk assessment), Tracer (funds and asset tracing), Speed Reader (document production review) and Blacklight (divorce financial analysis), together with the document reader they share. We may add, change or retire features, and will give Customers reasonable notice before removing anything they are actively using.
Advisory engagements are separate. Investigations, the Business Health Check and diligence support are delivered by Blue Horizon Group LLC as professional services under their own engagement letters, not under these terms. The analyst review that comes with an advisory engagement is part of that service. It is not a feature of the platform, and platform Customers supply their own professional review.
Customer accounts are set up by us as part of onboarding rather than by self-service signup. Sign-in is handled by our authentication provider, and a Customer may require its Users to use multi-factor authentication.
You are responsible for everything done under your Users’ accounts, for keeping credentials private, and for removing access promptly when someone leaves. Tell us straight away at the address in section 17 if you believe an account has been compromised.
Fees are charged per matter. A matter is one client and one dispute, transaction or engagement, opened as its own case on the platform. Work for a different client, or an unrelated dispute for the same client, is a separate matter and is opened as a separate case. A matter does not become two because it runs long, and two do not become one because they share documents.
Published prices are “from” prices: a flat fee covers a matter of ordinary size. For an unusually large document set, additional pages may be charged per page. You will be shown the page count and the resulting charge, and asked to confirm, before any per-page extraction is charged.
Fees are invoiced and payable on the terms stated on the invoice, and are exclusive of applicable taxes. Where storage for a matter grows well beyond its tier, we will tell you and agree an adjustment rather than interrupt a live matter.
“Customer Data” means the documents, statements and other material you or your Users submit, or connect from a source such as a shared folder, together with what the platform extracts from them. Customer Data belongs to the Customer. You grant us only the permission needed to host, process and analyze it to provide the platform to you, and to keep the service secure and working.
For the personal information inside Customer Data, the Customer decides why and how it is processed, and we process it on the Customer’s instructions.
This section is the commitment behind running a platform and a practice under one name.
Where a Customer wants the platform’s output to carry its own name, reports may be produced under that Customer’s branding for delivery to its own clients.
We use a small number of service providers to run the platform, each only for its own purpose:
We will provide the current list of providers on request and give notice before adding one that would receive Customer Data.
You are responsible for having the right to submit what you submit. In particular:
You agree not to misuse the platform: not to probe or disrupt its security, reverse-engineer it, reach data that is not yours, resell access without our agreement, or use it for anything unlawful.
The platform produces analysis for a qualified professional to review and act on. It is not legal, accounting, tax or investment advice, and it is not an expert opinion.
Findings describe what the documents show and do not account for. They are not a conclusion that any person has done anything. An undisclosed account, an unexplained transfer or a gap in coverage is a fact about the records submitted, and whether it means anything is a judgement for the professional using the platform.
Where a model reads a document, its reading is checked against that document’s own arithmetic before it is relied on, and every figure keeps a link to the page it came from. That makes the output checkable, not infallible. Output can only be as complete as the documents submitted, and you remain responsible for verifying anything before relying on it in a filing, report, testimony or decision.
Each of us will keep the other’s confidential information confidential, use it only for the purpose of this agreement, and share it only with people who need it for that purpose and are bound to protect it. That covers Customer Data on our side and the non-public parts of the platform on yours. It does not cover information that is public, was already known, or is independently developed, and either of us may disclose what the law requires, giving notice where permitted.
We use reasonable administrative, technical and physical safeguards appropriate to forensic and financial material, including encrypted connections and controlled access to the systems that hold Customer Data. If we become aware of unauthorized access to Customer Data, we will notify the affected Customer without undue delay and tell you what we know.
We keep Customer Data while the Customer’s matter is open on the platform, and delete it 90 days after the matter is closed.
A Customer may ask us to delete a matter or its account data sooner, at any time, and we will do so, subject only to what the law requires us to keep. On request we will return Customer Data in a usable form before deleting it. Backups age out on their normal cycle.
We own the platform, its software, its methods and its documentation, and these terms do not transfer any of it to you. Output produced for a Customer’s matter may be used by that Customer for that matter and its own work without further permission. If you send us suggestions, we may use them without obligation.
We will provide the platform with reasonable skill and care. Beyond that, and to the extent the law allows, the platform is provided “as is”. We do not promise it will be uninterrupted or free of errors, or that its output will be complete, and we disclaim implied warranties such as merchantability and fitness for a particular purpose.
To the extent the law allows, neither of us is liable to the other for indirect, consequential, special or punitive damages, or for lost profits or revenue. Our total liability arising from these terms is limited to the fees the Customer paid us in the twelve months before the event giving rise to the claim.
These limits do not apply to a Customer’s obligation to pay fees, to either party’s breach of confidentiality, or to liability that cannot lawfully be limited.
We may suspend access where it is needed to protect the platform or other Customers, or for unpaid fees after notice, and will restore it promptly once the reason is resolved. Either of us may end this agreement on written notice if the other materially breaches it and does not fix the breach within thirty days. A Customer may stop using the platform at any time.
We may update these terms. We will post the new version here with its date, and give Customers notice of material changes before they take effect. Continuing to use the platform after that means accepting them.
These terms are governed by the laws of the State of Georgia, and the state and federal courts located in Fulton County, Georgia, have jurisdiction over any dispute. If any part is found unenforceable, the rest continues in effect.
Questions about these terms, notices under them, and requests to delete data go to david@bluehorizonga.com. How this website handles visitor information is covered separately in the privacy policy.
